1. Agreement to terms

By accessing or using the Blueseal website (bluesealtech.com) or engaging Blueseal tech (pty) ltd for any services, you agree to be bound by these terms of service. If you do not agree to these terms, please do not use our website or services.

2. About Blueseal

Blueseal tech (pty) ltd is an AI automation business registered in South Africa, serving businesses anywhere in the world. We design and build automation systems, AI-assisted workflows, and internal tools for businesses. These terms govern both use of our website and engagement of our services unless a separate written agreement is in place.

3. Services

Blueseal provides custom AI automation and workflow solutions. The specific scope, deliverables, timeline, and fees for each engagement are agreed in writing before work begins. These terms of service apply to all enquiries and engagements unless superseded by a signed service agreement.

We reserve the right to decline any enquiry or engagement at our discretion.

4. Intellectual property

All content on this website, including text, design, graphics, and code, is the property of Blueseal tech (pty) ltd and is protected by applicable intellectual property law. You may not reproduce, distribute, or use any website content without our prior written consent.

Unless otherwise agreed in writing, any deliverables created for you as part of a paid engagement become your property upon receipt of full payment. We retain the right to reference the engagement in our portfolio unless you request otherwise.

5. Payment terms

Payment terms for each project are outlined in the relevant proposal or service agreement. Unless otherwise agreed:

• A deposit may be required before work commences.
• Invoices are due within 14 days of issue.
• Late payments may result in work being paused until the outstanding amount is settled.

6. Confidentiality

We treat all client information as confidential and will not disclose it to third parties without your consent, except where required by law. We expect the same courtesy in return regarding any proprietary methods, tools, or documentation we share with you during an engagement.

7. Data processing

In the course of providing automation services, we may process personal data on behalf of you or your business — for example, customer or lead records flowing through an automation we build for you. In that context, we act as a service provider or data processor, and you remain the controller of that data: we will only process it on your documented instructions and will not use it for our own purposes.

For engagements where this applies, a separate Data Processing Agreement covering security measures, sub-processors, and data handling obligations is available on request and forms part of the engagement once signed.

8. Termination

Either party may terminate an ongoing engagement by giving written notice, as set out in the relevant service agreement, or with 14 days' written notice where no other term has been agreed. Upon termination, you will pay for all work completed up to the termination date.

Sections of these terms that by their nature should survive termination — including intellectual property, confidentiality, data processing, limitation of liability, and governing law — will continue to apply.

9. Force majeure

Neither party will be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, internet or infrastructure outages, acts of government, or other events of force majeure.

10. Limitation of liability

To the maximum extent permitted by law, Blueseal tech (pty) ltd shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or services, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claim arising from a service engagement shall not exceed the total fees paid by you for that specific engagement.

11. Warranties and disclaimers

Our website is provided on an "as is" basis without warranties of any kind. We do not warrant that the website will be uninterrupted, error-free, or free of viruses.

While we strive to deliver high-quality work, we do not guarantee specific business outcomes or results from the use of any automation systems we build.

12. Acceptable use

You agree not to use our website or services to:

• Violate any applicable law or regulation.
• Infringe on the rights of others.
• Transmit harmful, offensive, or fraudulent content.
• Attempt to gain unauthorised access to our systems.

13. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the South African courts.

14. Changes to these terms
