Terms of service

These terms apply to use of bluesealtech.com and general interactions with Blueseal, the ICT services business of Blueseal Tech (Pty) Ltd. “Blueseal” is our operating name; the registered legal entity is Blueseal Tech (Pty) Ltd. These terms are drafted with South African law (including the CPA) in mind, alongside sensible limits for international visitors. Signed service agreements for managed IT, cloud, or security work override conflicting parts of this page where they explicitly apply.

Agreement

By accessing bluesealtech.com or contacting Blueseal or Blueseal Tech (Pty) Ltd through channels we provide, you agree to these terms. Blueseal is the operating name of Blueseal Tech (Pty) Ltd. If you do not agree, do not use the site. Specific ICT or security services are governed by a separate statement of work, order, or master services agreement where one exists. Those documents prevail for the services they cover.

The site

We aim to keep bluesealtech.com accurate and available, but we do not guarantee uninterrupted access or that content is free of errors. Materials are provided for general information and may change without notice.

Acceptable use

You may not misuse the site or our systems: no unlawful activity under the laws of the Republic of South Africa or your own jurisdiction (where they apply to you), no probing or attacking infrastructure, no scraping that degrades service for others, no impersonation, and no distribution of malware. We may suspend access where we reasonably believe these rules are violated.

Intellectual property

Branding, text, graphics, and other content on bluesealtech.com are owned by Blueseal Tech (Pty) Ltd and used under the Blueseal brand, or by our licensors. You may not copy or reuse them for commercial purposes without written permission, except as allowed by law (including fair dealing under South African law or comparable doctrines elsewhere).

Third parties

The site may link to third party sites or tools. We are not responsible for their content or practices. Your use of third party services is between you and that provider.

Disclaimer

To the fullest extent permitted by law, bluesealtech.com and its content are provided “as is” without warranties of any kind, whether express or implied, including merchantability or fitness for a particular purpose, subject to any rights you cannot waive under the Consumer Protection Act, 2008 (CPA) of South Africa or other mandatory consumer laws.

Limitation of liability

To the fullest extent permitted by law, Blueseal Tech (Pty) Ltd and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the site alone, whether you deal with us as Blueseal or under our registered company name. Our aggregate liability for claims relating to the site only (excluding paid services covered by a separate contract) is limited to the greater of five hundred South African Rand (R 500) or the amount you paid us specifically for access to the site in the twelve months before the claim, which is typically zero for casual browsing. Nothing in these terms limits liability that cannot be limited under the CPA or other law that cannot be contracted away.

Indemnity

You agree to defend and indemnify Blueseal Tech (Pty) Ltd (including the Blueseal brand and operations) against claims arising from your misuse of the site or violation of these terms, except to the extent caused by our wilful misconduct or gross negligence, or where the CPA or other law prohibits such an undertaking for consumers.

South Africa (governing law and courts)

Blueseal Tech (Pty) Ltd, which operates the Blueseal ICT services brand, is incorporated in South Africa. These terms, and any dispute arising from use of bluesealtech.com (except where a written services agreement chooses different governing law for those services), are governed by the laws of the Republic of South Africa. You consent to the jurisdiction of the South African courts that have competence, on a basis that does not exclude other forums where the law allows. If you qualify as a consumer under the CPA, you retain any rights and forums that the CPA affords you and that cannot be taken away by contract.

Other jurisdictions

If you access the site from outside South Africa, local mandatory consumer or privacy rules may also apply. Where those rules cannot lawfully be contracted away, they prevail to the minimum extent required.

Changes

We may update these terms periodically. Continued use of bluesealtech.com after changes constitutes acceptance of the revised terms where the law allows. The date below reflects the latest revision.
